his heirs and assigns all the right title interest and claim of D.A. Merchant
his heirs executors and administrators of in and to all crops whatsoever Species
kind or description now growing or which may hereafter at anytime in the future
be planted grown or gathered by me or for me or for my benefit in or off of any
and all lands in Alachua County Florida until the debt hereby secured
with interest is fully paid also the following described property to wit
One Black mule twelve Years old name Mack To Have and to Hold all and
singular the crops lands and personal property above bargained and
Sold unto the said W.H. Traxler heirs executors administrators and assigns
forever Provided nevertheless that if the said D.A. Merchant should well and
truly yay or cause to be paid unto the said W.H. Traxler the full amount of
the advances heretofore made and hereafter to be made with the charges for
commission and interest on the same then this obligation to be void else to remain
in full force and virtue And it is further agreed that all amounts heretofore
and hereafter advanced are due and payable upon delivery of the goods
therefor and shall bear interest accordingly and that this instrument may be
enforced at any time at the option of the said W.H. Traxler And it is
hereby further agreed that should it become necessary to enforce this instrument
by legal proceedings the said D.A. Merchant will pay therefor all attorney's
fees charges and expenses. In Witness Whereof I have hereunto set my hand and
affixed my seal this 20th day of February AD 1886
