these presents are on this express condition that if the said James
M. Stuart and wife their heirs executors or administrators shall well
and truly pay unto the said party of the second part his heirs
executors or administrators or assigns the said sum of money in said
promissory note hereinbefore described and set forth together
with the interest thereon as stipulated and agreed in said note
at the time and place of paying the same according to the true intent
and meaning of this mortgage instrument including especially all taxes
and assessments upon said described property to be paid when the same
shall be required by law and every other charge thereon together
with all costs charges and expenses which the said party of
the second part may incur or be put to in collecting the same by foreclosure
or demand of Attorney or otherwise that then these presents and the Estate
hereby granted shall cease determine and be absolutely null and void
and the said parties of the first part for themselves and their heirs executors and
administrators covenant and agree to pay unto the said party of the second part
his heirs executors administrators or assigns the said promissory note and
interest as aforesaid and the taxes as aforesaid and all costs charges and
expenses which John M. Graham the party of the second part may
incur or be put to in collecting the same by foreclosure including a
reasonable Attorney's fee chargeable to the within described property
that it is agreed further by the said first parties with the party
of the second part that should they fail to pay the interest for
a space of ten days when the same shall become due and payable
such failure shall cause the principal and interest both to
become due and payable and subject to a foreclosure of the Mortgage
as though the whole term thereof had expired. In Witness whereof
the said parties of the first part have hereunto set their hands
and seals the day and year first above written.

County of Orange }  Know all men by these presents that I Mary L.
Stuart wife of the above named James M. Stuart do by these presents
made and executed by me separate and apart from my said husband
and in the presence of M. Silver a Notary Public of the State of Florida
acknowledge and declare that I did make myself a party to and
execute the foregoing Mortgage Deed for the purpose of
relinquishing my dower and all separate Estate in and to
the lands in said deed described and mortgaged and that I
did the same freely and voluntarily and without any compulsion
constraint apprehension or fear of or from my said husband.
In Witness whereof I hereunto subscribe my name and affix my
seal this 15 day of June 1886.
