                   In Circuit Court of the Fifth Judicial
                      Circuit of Florida, in and for Alachua,
                        County  - In Chancery -
W.K. Hathcox, Complainant }
          vs              } Divorce
Catherine Hathcox, Deft   }
                          }
                             This cause coming on for a
final hearing upon the report of Robert E. Davis, Special
Master appointed by the Court, to take testimony of the com-
plainant and proof of complainant's bill, and it appearing to
the Court here from the evidence produced before said Special
Master that all material allegations of complainant's bill
are true, and that the defendant Catherine Hathcox has been guilty
of reported acts of cruelty toward the complainant and that the
defendant habitually indulges in violent and ungovernable
temper toward the complainant. It is therefore upon con-
sideration thereof ordered adjudged and decreed that the
marriage existing between the said W.K. Hathcox and
Catherine Hathcox be and the same is hereby dissolved
and declared null, and void.
Done and ordered in the town of Inverness, Florida,
this 8th day of January AD 1897,

Bill of exceptions signed 11th day of Feby 1895,
 The First assignment of error is briefly that the verdict
was contrary to the evidence and that the County Judge
erred in not setting aside the verdict on that ground.
 The second assignment of error is briefly that the County
Judge erred in not setting aside the verdict & granting
a new trial to the appelant (deft below) in as much as
the evidence showed the payment of the debt to J.H. White
before the suit was brought.
