matters therein contained are not sufficient in law to preclude the said plaintiff
J.M. Turner for having and maintaining his said action against the said defendant
in manner and form as he the said plaintiff hath above alleged: Wherefore the said
plaintiff ought to recover against the said defendant his damages on
occasion of the premises; and because it is suggested and proved and
manifestly appears to the court here from evidence here filed before the court
that the said plaintiff hath sustained damage on occasion of the non
performing the premises and undertakings by the said defendant in the
declaration mentioned to the sum of Eighteen hundred & thirty Eight & 52/100 Dollars
besides his costs and charges by him about his suit in this behalf expended
therefore it is considered by the Court here, that the said plaintiff, the
said J.M. Turner recover against the said defendant, the said H.A.
Williams as well the sum of Eighteen hundred & thirty Eight 52/100 ($1838.52)
Dollars the damages in the declaration of the said plaintiff mentioned
with interest thereon from this day until paid at the rate of Eight per cent per
annum, as the of Eight & 58/100 Dollars adjudged by the Court unto the said
plaintiff for his costs and charges by him about his costs and charges by him
about his suit in this behalf expended and the said defendant in mercy &c

Madison E. Weeks } This cause came on to be heard upon a motion
to quash the Writ and to dismiss the suit upon the grounds set
forth in the special appearance entered herein by the defendant
on December 2. AD 1895. service of which notice has been accepted
by defendants attorney; and no motion to amend having been
made by the plaintiffs. It is ordered that the alias writ herein
be quashed and that said suit be and the same is hereby
dismissed and that the Clerk of said court do make record of this
order. Done and ordered a chambers at ocala Florida, this the
22d day of September AD 1897
