in any manner belonging unto him the said Horace Merry his
heirs and assigns forever, Subject to this, and the following reservation
that, in case the Moses E. Levy or his heirs assigns or legal representatives
should determine to reclaim by drainage any lands now owned
or held by him the said Moses E. Levy, and it should be necessary to
take water by ditch or canal through the land hereby, and by this
indenture conveyed then the said Horace Merry agrees to, and the
said Moses E. Levy reserves the right of cutting such ditch or canal
through said land as above described, and for the purposes above set
forth; And the Said Moses E. Levy for himself his heirs executors
or administrators the said bargained premises unto the Said Horace
Merry, his heirs or assigns will warrant and forever defend, subject
always to the foregoing reservation,
     In witness whereof the said Moses E. Levy hath hereunto

Clerk of the Circuit Court for the Counties of Alachua and Levy
James Child one of the Subscribing witnesses to the foregoing instru-
ment of writing and after being duly Sworn says that he saw
Moses E. Levy Sign the said instrument of writing for the purposes
therein mentioned and that he executed the same in the presence of
the other subscribing witness
