This Indenture made this the Tenth day
January in the Year One Thousand Eight Hundred & fifty
between Bennett M. Dell and Samuel R. Piles Executors of
the last will and testament of James Dell deceased and
Samuel R. Piles and his Wife Ann L. Piles late Ann L. Dell
Daughter of Said James Dell and Samuel R. Piles
Guardian of James Philip Dell Florida Ann Dell &
William Thomas Dell
infant Children of William Thomas Dell who was
also a son of the late James Dell deceased and
Martha Mary Delia Dell Daughter of Said James
Dell deceased heirs legatees distributees and
Claimants under the last and Testament of Said
James Dell deceased of the first part and
James Gadsden Dell who is also an heir legatee
distributee and Claimant under the Said will
of the Second part Witnesseth, That whereas of
the last will and Testament of Said James Dell there
is a request and direction to this affect, to Wit
My will is that Big Jim who has as all times
and in all troubles Stood by me Shall have
the election either to remain a slave to Some of my
Children else to pay my executors the Sum of one
Hundred Dollars per year, the Same to be equally
divided Among my Children, When he Shall be
free and my executors are charged with the trust
in the event of his complying with this proposition
to give to him emancipation and I hereby Charge
My Estate to Comply with the law So far as to carry
this request in to execution of the Election of Jim
