his heirs and assigns forever, or as he or they should direct and
appoint and it is also further provided amongst other things that it shall
be lawful for the said Seraphina Chauvituau, her heirs and assigns in
case default shall be made in payment of the said sum of fifty thousand
francs and interest at the note and terms aforesaid to enter into
have hold occupy and possess all and singular the tracts and parcels
of land they intended to be released and conveyed with the
appurtenances, and it is further provided also that in case
default shall happen to be made in two half yearly payments of
interest at the date and time and place aforesaid it shall be lawful
for said Seraphina Chauviteau or executors administrators or assigns
immediately to demand payment of the said sum of fifty thousand
francs and all interest then due thereon, not withstanding the term
of six years for which the same sum of money is thereby intended
to be advanced shall not be then expired or near expiring and
in case of the nonpayment thereof to enter and take possession
of the said tract or parcels of land and premises thereon before mentioned
and whereas default has been made by the said Moses Elias Levy
in the payment of several of the said half yearly payments of interest
in the note and time and place mentioned in the said indenture
and the same are now due and owing to the Seraphina Chauviteau
wherby she has become entitled to enforce the payment of the siad
fifty thousand francs with all the interest now due them and to
enter into and upon and take possession of the said several tracts
or parcels of land heriditaments and premises with the appertenances.
   Now know ye that she the said Seraphina Chauviteau
hath made ordained and nominated constituted and appointed 
by these presents doth make ordain, nominate constitute and
appoint William Washington Russell of the City of New York her true
and lawful attorney for her and in her name, but to and
for her now to ask demand sue for recover and receive of and from
the said Moses Elias Levy, his heirs and executors, adminstrators
or assigns or of and from whomsoever it shall or may belong to pay the
same, the said capital or principal sum of fifty thousand francs
together with all the interest now due and to accrue due thereon and
upon receipt therof or of any part or parts thereof for her and in her
name to make and give all such good and sufficient receipts
releases acquitences and discharges as may be necessary and
proper and in default of payment thereof for her and in her
name to begin commence and prosecute any action
or actions suit or suits or other proceedings, in any court
or courts of law or equity for the recovery or the same
or any part thereof and the same actions suits or other
