Second - Your Petitions further show
unto your Honor that appended to the
original Will, which has been admitted to
Probate as aforesaid, in what purports to be
a Codicil in the following words:-
  "Codicil I leave Forty acres at Matanzar,
St Johns County, To St Mary's Orphan Home,
I leave Forty acres to St Augustine Church
for masses to be said for repose of my soul
number to be mentioned by future
Bishops. I leave Forty Acres to my nephew
Patrick Fitzpatrick in the Matanzar
district. My furniture bric a brac and
pictures I leave to my niece Margaret
Fitzpatrick My books except the Catholic
Encyclopedia which I leave to St Patricks
Church Gainesville I leave to my nephews
and nieces."
  That this purported Codicil attached to
the original Will is not signed by the testator,
and undertaken to convey real and personal
property and that under the Statutes the
Codicil (which we will for identification
call Codicil No 1) is invalid and illegal.
  Your Petitioners therefore pray that
said Codicil No 1 be disallowed and not admitted
to probate, but that said Codicil No 2, being in
accordance with the Statutes of this State regu-
lating the devising of personal property, be declared
valid and admitted to probate in accordance herewith
the said original Codicil being attached to and made a
part of this Petition and marked "Exhibit No 1."
      And your Petitioners will ever pray, etc.
