the argument of Counsel and the Charge of the Court
retired to consider of their verdict and thereafter
on the same day returned into open Court and
rendered the following verdict to wit: We the
Jury find the prisoner not Guilty

Whereupon the Court ordered that a Special
Venire Facias be issued to the Sheriff to Summon
Thirty persons to Serve as Petit Jurors; from the
Body of the County.
Whereupon the Court adjourned until half past nine
oclock tomorrow morning

The Court met pursuant to adjournment of yes-
terday His Honor James M. Baker Judge of the 4th
Judicial Circuit presiding Judge of the 5th Cir-
cuit

And now this Cause Coming
on to be heard William A. Hocker States attorney
for the fifth Judicial Circuit of Florida prosecu-
ting in the name and by the authority of the
State of Florida and the prisoner appearing in
his own proper person as well as by his attorneys
Mess McCall & Thrasher, and now the prisoner being
brought to the bar here under the Custody of John
W. Turner Sheriff of Alachua County to which Sheriff
he is also likewise committed and being forthwith
demanded how he would acquit himself of the Charge
against him saith that he is not guilty as the Indict-
ment alleges against him and for good and evil he
puts himself upon God and the Country for trial
Whereupon a Jury was called and there Came
M.E. Ward, W.N. Tillman, O.W. Sykes, J.W. Tompkins
Wm L. Campbell, Geo S. Merchant, Willis Reid A.T.
Zetrouer, Jefferson Kendrick M.G. McCarroll
Jno W. Hagan and T.E. Haile Jr. who were duly
Sworn and empanelled to well and truly try the
difference pending between the State of Florida
