Adjourned Fall Term of 1882
      Thursday January 18th 1883
person as well as by his attorneys Messr Taylor &
Sanchez and now the prisoner being brought to
the Bar here under the custody of John W. Turner
Sheriff of Alachua County to which sheriff he
is also likewise committed and being forthwith
demanded how he would acquit himself of
the charge against him saith that he is not
guilty as the Indictment alleges against him
and for good and evil he puts himself upon
God and the country for trial. Whereupon a
Jury was called and now J.B. Mixson was
tendered By the State and accepted of by
the Defence but not duly sworn and empan-
elled -
Whereupon the regular venire being now exhausted
The Sheriff was directed by the Court to Summon
Fifty persons from the body of the County and
not to summon any person who was there in
the Court Room to which order the Counsel
for the Defendants then and there excepted
and that he make return of the same at
half past Two Oclock P.M. of this day -
Whereupon it is ordered that the hearing of this
cause is adjourned until half past Two
oclock =
Whereupon the Court adjourned until half
past Two Oclock - P.M.

The Court met pursuant to adjournment
His Honor Enock J. Vann Judge of the Third
Judicial Circuit presiding as Judge of
the Fifth Circuit:

State of Florida }  Hocker, Finly & Hampton
       vs        }  Rape
William Ellis    }  Taylor & Sanchez
                    And now the hearing of
this Cause is resumed and the prisoner
in his own proper person as likewise the Counsel
for both the state and the Defendant being present in
open Court And now the Sheriff having returned the names
of the Fifty Persons ordered to be summoned
from the body of the County -
Whereupon the State retendered J.B. Mixson
