Rivers, Frank Stewart, the hearing of this Cause
is resumed and thereafter after hearing the
balance of the evidence the argument of Counsel
and the Charge of the Court retired to Consider of
their verdict and thereafter on the same day
returned into open Court and rendered the
following verdict to wit:

Whereas the prisoner was discharged and the
witnesses for the State ordered discharged sine
die

                  And now this Cause is con-
tinued by the Plaintiffs

Ishmael Sapp     }  Gardner & McCall
                 }  And now John W. Turner
having returned the writ as having been ex-
ecuted by bringing the prisoner into open
Court and that he detains the said Ishmael
Sapp by reason of a Fine of Fifty dollars
imposed on him together with the costs of
suit and that the said prisoner is insolvent
and unable to pay the costs & Fine aforesaid
Whereupon the Court after argument had
by Counsel issued the following order to wit =
upon consideration it is adjudged by the Court
that the prisoner Ishmael Sapp is not entitled
to his release from Custody it appearing that he
has not been confined in the County Jail a time
sufficient long to discharge the fine & costs
of prosecution mentioned in the petition herein
at the rate of per diem allowed by the Statute
