} And now this Cause coming on to
be heard and the issues being joined a Jury was
called and there came, E.C. Bailey, J.J. Jones
J.B. Mixson, James Bradshaw, J.R. Zetrouer and
Ambrose Abbott, who were duly sworn and
empanelled to well and truly the issues joined
and thereafter after hearing a part of the evidence
Whereupon the Court adjourned until tomorrow
morning at Nine oclock =

And now the prisoner John
Lee being in open Court and as likewise the
Counsel for both the State and for the Defen-
dant. And now this Cause Coming on to be heard
on a motion for a New Trial. And thereafter
after argument had and due consideration by
the Court thereon the Court overruled the said
Motion for a New Trial to which said ruling
the Defendant by his attorneys then and there
excepted.
Whereupon the Counsel for the Defendant gave
notice of appeal in open Court in the words
