after argument had and due consideration
denied said motion, to which ruling and
decision of this Court the Defendant by his
Counsel then and there excepted

} And now the
Court having considered of this Cause rendered
the following order herein to wit:
State of South Carolina }
Charleston City } This Indenture made and
entered into on this 19th day of October A.D. 1859 by
and between Phineas M. Nightengale of Cumberland
Island in the State of Georgia and his wife Mary
K. Nightengale parties of the first part and William
M. Tunno Esqr of the City of Charleston in the
State of South Carolina party of the second part
Witnesseth, that, the parties of the first part for
and in consideration of the Sum of Four Thousand
Dollars to them in hand paid by the party of the
second part at and before the ensealing and
delivery of these presents the receipt whereof is
hereby acknowledged, have granted, bargained
sold, aliened, released and conveyed, and by these
presents do grant, bargain, sell, alien, release
convey and confirm unto the party of the second
part all of the right title interest claim and dem-
and at law or in equity which the parties of the
first part now have or may be entitled to of in and
to or over all of that Certain tract section, plat or
parcel of land situate lying and being in the State
of Florida in the County of Alachua and designated
upon the maps of plotts of what is there in Florida
known as the "Arredondo Grant" made by Burr
and Washington as Lot No. Six (6) of the Moses E.
Levy Grant of Twenty thousand (20,000) acres and
said lot containing Sixteen hundred and Sixty Six
(1666) acres more or less, Together with all and Singular
the tenements hereditaments and appurtenances
to the same belonging or in anywise appertaining
To have and to hold the same unto the party of
