Adjourned Fall Term of 1882
       Tuesday January 23rd 1883
The Court met pursuant to adjournment of yesterday
His Honor Enock J. Vann Judge of the Third Ju-
dicial Circuit presiding as Judge of the 5th
Circuit
D. Prosky    }
      vs     }  appeal from J.P. Court
T.M. Cauthen }
             }  And now this cause having been
submitted to the Court on yesterday for decision
and this appeal came on to be heard upon the error
assigned to wit: that the verdict of the Jury is contrary
to the evidence and it appearing that all the evidence
considered by the Jury has not been made a part
of the record herein, It is considered and
adjudged that this appeal be dismissed
with Costs against appellant and that the record
with this Judgment be remanded to the Court
below for further proceedings pursuant to law

                      3rd Circuit presiding

And now the Court for good and sufficient
cause remitted the fine of Twenty Five dollars
imposed on John W. Turner Sheriff for neglect to
keep order in the Court, as also the fine of Ten
dollars imposed on Lewis Ellis defaulting
Juror.

Whereupon it is ordered Considered and adjudged
that all Causes herein pending not otherwise
disposed of at this term of the Court be Con-
tinued Generally
Whereupon the Court adjourned Sine Die
