if they were willing content that the Court should alter
a matter of form and not a matter of substance
to which the assented.

were discharged from further attendance on this

} And now this Cause
coming on to be heard it is on motion of the Plain-
tiff ordered that the names of the Plaintiffs Richard
Templeton and Harman Templeton be stricken from
this cause and that the Cause proceed with the other
Plaintiffs in and now the issues being joined and
the parties Plaintiff and Defendant appearing by
their respective attorneys whereupon a Jury was
Called and there came Jas K. Leary, G.S. Riggs,
Frank Stewart Edward Taylor Geo M. Blitch and
Joseph Voyle who were duly sworn and empanelled
to well and truly try the issues joined and thereafter
after hearing the evidence the argument of Counsel
