In the matter of the Petition } Baker County
of Isaac Eppenger and }
John K. Russell to reestablish}
a lost deed. }
On reading the petition of Isaac Eppenger and John
K. Russell filed in this Court praying that a copy of a
certain deed ****** bearing date the 1st day of April
A.D. 1875 be established in lieu of the original.
And it appearing to the court that thirty days notice
in writing, accompanied with a substantial of said deed
had been given to the person who made or executed said
deed and to all others liable therefor stating that the
original has been lost and that appication would
be made to this term of the Circuit Court for Baker
County Florida to establish a copy in lieu thereof
And it appearing further that a substantial copy of
said deed under oath has been filed with the Clerk
of this Circuit with a statement that the original of
said deed has been lost or mislaid so that the same
is not within the custody or control of the petitioners
And it appearing further that the notice aforesaid
has been regularly served as required by the statute
and there being no cause shown to the contrary,
It is thereupon ordered and adjudged that said copy
be established in lieu of the original and that the
same be as valid and effectual for all legal purposes
as the original could have been had the same not
been lost.
This matter has been Transferred to the circuit
court of Alachua County Florida because the Judge of
the 4th Judicial Circuit of Florida was incompetent to
hear and determine the same
