} and now this cause coming
on to be heard and the issues being joined a
Jury was called and there came T.N. Moss
S.V. Gaskins -- T.L. Boulware -- W.E. Bevill, T.J. May
Eli Futch who were duly sworn and empanelled to
well and truly try the issues joined and thereafter after
hearing the evidence the argument of counsel and the
charge of the Court retired to consider of their
verdict and thereafter on the same day returned into
open court and informed the Court that they were
unable to agree upon a verdict whereupon a
mistrial was ordered to be declared by the Court
Whereupon by consent of the Parties Plaintiffs and
Defendant filed a written agreement in open Court
agreeing that this cause should be dismiss upon
the payment of the Costs. Each paying one half of
said costs.
Wherupon the Court adjourned until tomorrow
morning at nine oclock
