And now the Jury to wit
D.G. Harvard Benj Haile, Jno D. Young W.W. Bourn
R.B. Peeler Z.T. Taylor who had been by Consent
allowed to disperse on yesterday being now
in open Court retired to consider of their
verdict and thereafter on the Same day returned
into open Court and announced to the Court
that they were not able to agree on a verdict
Whereupon the Court declared a mistrial and
discharged the Jury from further consideration of
this cause.

} And now this cause coming on
to be heard and the parties plaintiff and defendant
appearing in open Court by their respective
Attorneys and now the issues being joined a Jury
was called and there came G.R. Walton J.R. Flewellen
Jno A. Rosborough, J.W. Shackleford, Jno M. Miller *
T. Foster who were duly Sworn and empanelled to
well and truly try the issues joined according to the
evidence and thereafter after hearing the evidence
Whereupon the Court adjourned until tomorrow
morning Nine O'clock
