The Court met pursuant to adjournment

} And now the parties plain-
tiff and defendant being in open Court by
their respective attorneys as also the Jury who had
been duly Sworn and empanelled herein on
yesterday to wit: W.D. Seigler, Wm M. Bradford
Allen Goolsby Alex Avera L.L. Hill Jas R. Craw-
ford the hearing of this Cause was resumed
and the Jury aforesaid after hearing the Charge
of the Court
Whereupon now comes the plaintiff and
withdraws the Jury and takes a non suit in
this Cause.
Whereupon it is ordered Considered and
adjudged that the Defendant do have and
recover of and from the Plaintiff the Sum of
Dollars and
Cents as their Costs in this behalf
expended and the Plaintiff in Mercy &c

And now this Cause
coming on to be heard and the parties plaintiff
and defendant being in open Court by their
respective attorneys and the issues being joined
a Jury was called and there came Robt C.
Davis Jas Vanlandingham T.N. Sewell, S.J. Peeler
W.D. Seigler, E.C. Beach, who were duly Sworn and
empanelled to well and truly try the issues joined
and a true verdict give according to the evidence
and thereafter hearing a part of the evidence
Whereupon the Court adjourned the further hearing
of this cause until tomorrow morning and
