Whereupon the Court asked the Grand Jury if
they were content that the Court shold alter a
matter of form and not a matter of substance
to which the Grand Jury assented -
Whereupon the Court adjourned until tomorrow
morning at Nine Oclock

The Court met pursuant to adjournment of yesterday

} And now the Pleas and
Demur filed herein are withdrawn by Consent of
the Parties Plaintiff and defendant and the
Defendant is allowed until Monday next in
which to file new pleas.

Richard Clark } with intent to Commit a Misde-
} meanor

And now this Cause
Coming on to be heard W.A. Hocker State
attorney prosecuting in the name and by
the authority of the State of Florida and
the Prisoner appearing in his own proper
person as well as by his attorney S.Y.
Finley whereupon the prisoner being forthwith
demanded how he would acquit himself of
the Charge against him saith that he is not
guilty as the Indictment alleges against him
and for good and evil he puts himself upon God
and the Country for trial - Whereupon a Jury
was called and there came D.L. Ferguson
Thos R. Bennett, L.A. Jernigan and Jno W.
Barrett C.A. Butler and E.C. Garnr who were
duly Sworn and empanelled to well and truly
try the difference pending and thereafter
