                              }  And now this Cause is
             Continued

             State of Florida }  Hocker
No 20               vs        }  Breaking and entering a building
             Frank Davis      }  in the night time with intent to
             Wm Hofman &      }  Commit a Felony
             Charlie Hicks    }  S.Y. Finley for Davis & Hofman
                              }
                              }  And now this cause coming
             on to be heard W.A. Hocker State attorney prosecuting
             in the name and by the authority of the State of
             Florida and the prisoners Frank Davis and William
             Hofman appearing in open Court in their proper person
             as well as by S.Y. Finley their attorney and now as
             severance as to Frank Davis & William Hofman is
             ordered by the Court and Frank Davis being now
             forthwith demanded how he would acquit himself
             of the Charge against him saith that he is not guilty
             as the Indictment alleges and for good and evil he
             puts himself upon God and the Country for trial
             Whereupon a Jury was called and there came J.D. George
Isaac Mizell L.W. Fennell, O.B. Bailey, J.S. Crown Jr. and now the
             Venire being exhausted there came C.C. Powell and
             W.H. Williamson from the bystanders all of whom
             were duly sworn and empanelled to well and truly
             try the difference pending and thereafter after
             hearing a part of the evidence, Whereupon the
             Jury aforesaid under instructions from the
             Court were allowed to disperse until Nine oclock
             tomorrow morning

             Whereupon the Court adjourned until tomorrow
             morning at Nine oclock
