try the issues joined and now the Court having
Considered the motion to strike defendants pleas
refused said Motion to which ruling the
plaintiff by his attorney then and there excepted
And the Jury aforesaid after hearing a part
of the evidence
It appearing that there will be a second week of this term
of the Court it is ordered that a venire issue for Eighteen petit
Jurors to serve the second week said Jury to be drawn as
required by law the venire to be returnable by 9 Oclock AM of
Monday next

And now the parties plaintiff
and defendant being in open Court by their respective
attornys at also the Jury who had been duly Sworn and
empanelled on yesterday to wit: J.G. Dampier Verd Polk
J.G. Bevill James Love L.H. Johnson and A.C. Massey
the hearing of the this Cause is resumed - and the
Jury aforesaid after hearing the evidence the argument of
Counsel and the Charge of the Court retired to Con-
sider of their verdict and thereafter on the Same
day returned into open Court and rendered the
following verdict to wit:

We the Jury find the de-
fendant guilty and assess the plaintiffs dama-
ges at Five hundred and Seventy five ($57500 dollars
