  Fall Term A.D. 1885
       Monday December 7th 1885
truly try the difference pending and thereafter after
hearing the evidence retired to consider of their
verdict and thereafter on the same day returned
into open Court and announced to the Court
that they could not agree on a verdict whereupon
the Court ordered that a mistrial be declared
and the Jury discharged

State of Florida }  Hocker
         vs      }  Assault with intent to Murder
Caesar Joiner    }  Goss & Dunson & S.Y. Finley
                 }
                   And now this Cause coming
on to be heard W.A. Hocker State attorney prosecu-
ting in the name and by the authority of the
State of Florida and the prisoner appearing in
open Court in his own proper person as well
as by his attorneys Goss & Dunson & S.Y. Finley =
And now the Prisoner being demanded how he
would acquit himself of the Charge against
him Saith that he is not guilty as the
Indictment against him alleges and for good
and evil he puts himself upon God and the
Country for trial Whereupon a Jury was called
and there came L.C. Ellis - M.M. May - Robert
Kite, R.M. Davis and now the regular panel
of the Jury being exhausted there came from the
bystanders J.T. Spriggs and E.D. Hodges who were
duly Sworn and empanelled to well and truly
try the difference pending and thereafter after
hearing the evidence

Whereupon the Court adjourned until tomorrow morning
at Nine Oclock
