the hearing of the motion was adjourned until

And now the hearing of a
motion for a New Trial was resumed - Whereupon
it is ordered that the Court will not consider
the affidavits in this cause -
Whereupon it is ordered Considered and adjudged
that said motion for a New Trial be not
granted to which ruling and Judgment of said
Court the Defendant then and there excepted
by his counsel
Whereupon the Court allowed the Defendant Sixty
days in which to make and have settles his Bill
of Exceptions
Whereupon the Defendant in open Court filed his
notice of appeal to the Supreme Court in the
words and figures following to wit
