State of Florida } Hocker
        vs       }  Murder
John Austin      }  Cone & Dunson
                    And now this cause coming on to be heard
William H. Wigg State attorney prosecuting in the name and
by the authority of the State of Florida and the prisoner appearing
in his own proper person as well as by his attorneys Messers Cone
& Dunson And Now the prisoner John Austin being brought to
the bar here under the Custody of Samuel C. Tucker Sheriff
of Alachua County to which Sheriff he is also likewise
committed and being forthwith demmanded how he would
acquit himself of the charge against him saith he is not guilty
as the Indictment against him Alleges and for good and evil he puts
himself upon God and his Country for trial whereupon a Jury
was called and there came 1 M.G. McCarroll 2 S.B. Stephens 3 Marion Campbell
4 Jas Bradshaw 5 Jas D. Matheson 6 W.J. Knight 7 J.J. Saunders 8 O.A. Thigpin 9 J.A.
Shannon 10 B.J. Mills and now the venire being exhausted the Court
ordered the Sheriff Samuel C. Tucker to summon from the body of the County
a Sufficient number to fill the Jury and there came 11 E.C. Pound
12 S.C. Bevill who were duly sworn and empanelled to well and truly
try the difference pending between the State of Florida and John
Austin the prisoner at the bar and thereafter after hearing the
evidence the argument of Counsel and the Charege of the Court
retired to there room under the Charge of Wm F. Flynn Bailiff who
had been regularly sworn as such Bailiff to consider of their verdict

Whereupon the Court adjourned until tomorrow morning half past
Eight O'clock
