      Spring Term A.D. 1886
               Wednesday May 12th 1886
by authority of the State of Florida and the Prisoner appearing in open
Court in his own proper person as well as by his Attorney and now being
demanded how he would acquit himself of the charge against him
saith that he is not guilty of the charge as the Indictment alleges against
him and for good and evil puts himself upon God and the Country
for trial Whereupon a Jury was called and there came D.A. Miller S.B.
Stephens W.J. Knight W.H. Baltzell H.A. Varnum and J.A. Shannon who
were duly sworn and empanelled to well and truly try the difference pending
between the State of Florida and the Prisoner Isaac Waiters and thereafter after
hearing the evidence the Argument of Counsel and the charge of the Court
retired to consider of their verdict and thereafter on the same day returned
into open Court and rendered the following verdict to wit: We the
Jury find the defendant guilty of Aggravated Assault.

Tom Mitchell     }
                And Now this cause coming on to be heard William A.
Hocker State Attorney prosecuting in the name and by authority of
the State of Florida and the prisoner appearing into open Court in
his own proper person as well as by his Attorney and now being demanded
how he would acquit himself of the charge against him saith that he
is guilty of the charge alleged in the Indictment

Tom Mitchell     }
                   And now the Prisoner Tom Mitchel being in open
court for Sentence was demanded if he had anything to Say why
Sentence Should not be passed upon him Saith nothing whereupon
the Court sentenced the prisoner Tom Mitchell to confinement at
the State Penitentiary at hard labor for the Space of three (3) Years.
