for the Parties Plaintiff and Defendant and now
the Court being advised of its opinion granted
the motion for a New Trial upon the condition that
the Defendant pay all costs of Court
Whereupon the Court adjourned until tomorrow
morning at half past Eight oclock

to be heard William H. Wigg State attorney prose-
cuting in the name and by the authority of the
State of Florida and the prisoners appearing in
their own proper persons as well as by their
attorney S.Y. Finley were demanded how they would
acquit themselves of the Charge against them saith
that they are not guilty whereupon a Jury was
Called and there came Geo Easterlin, E.F. Hawthorn
James Chesnut, Burrel Wiggins, J.R. Faircloth
H.N. Richard who were duly Sworn and empanelled
