The Court met pursuant to adjournment of yester-
day his Honor James B. Dawkins Judge presiding
Josiah T. Walls } E.C.F. Sanchez
vs } Forcible Entry and unlawful detainer
M. Endel & Son } Goss Thrasher & Hampton
And now the Jury in this
cause who had been duly sworn and empan-
elled on Thursday April 28th 1881 to well and truly
try whether the defendant at any time within three
years before the filing of the Complaint in this
Cause did forcibly or unlawfully enter upon the
property in the Complaint mentioned and turned
the plaintiff out of the possession thereof and
whether the defendants Continued to hold the pos-
session thereof at the time of the filing his Com-
plaint and you shall find a true verdict thereupon
and assess such damages as may be recoverable ac
cording to the evidence to wit J.D. Matheson McK
F. McCook M.S. Cheves, G.W. Watts, A.J. Collins
and W.W. Scott came into open Court and
rendered the following verdict to wit
Josiah T. Walls } In the Circuit Court of Alachua
vs } County 5th Judicial Circuit of
M. Endel & Son et al} Florida
We the Jury find that the Defendants did within
Three years next before the filing of the Complaint
in this Cause forcibly and unlawfully enter upon
the real estate in the Complaint mentioned and
turn the Plaintiff out of possession thereof: that
the said Defendants did continue to hold
the possession thereof at the date of the said
Complaint, and we assess the damages at
Three hundred and Ninety Dollars

This Judgment heretofore transferred to
me is hereby marked settled and satisfied
as per agreement of settlement of this date
between the plaintiff and defendants in this
suit O.D. Morris
Satisfied and settled as Judgment
between the parties this Oct 26th 1885

Whereupon it is ordered Considered and adjudged
by the Court that the Plaintiff do have and recover
possession together with their his Damages amounting
to Three hundred and Ninety dollars together
with his costs in this behalf expended taxed at
Eighty Nine Dollars and Eighty Seven Cents and
that the writ of Habere facias possessionem be
be issued and also a writ of Fieri facias be issued for
the amount of his damages together with his Costs
