Fall Term A.D. 1887
  Thursday December 15th 1887
God and the Country for trial whereupon a Jury was
called and there came W.S. Land, W.B. Patterson
Leroy N. Pearce M.A. Dinsler T.M. Cauthen J.E.
Haynesworth who were duly Sworn and empanelled
to well and truly try the difference pending and
thereafter after hearing the evidence the argument of
Counsel and the Charge of the Court retired to
Consider of their verdict under instructions from
the Court to bring in a sealed verdict

Whereupon the Court adjourned until
tomorrow morning at Nine Oclock

Fall Term A.D. 1887
  Friday December 16th 1887
The Court met this day pursuant
to adjournment of yesterday His
Honor J.J. Finley Judge presiding

State of Florida }  Wigg & Ashby
        vs       }  Assault with intent
Joe Smith        }  to Rape
                 }  Taylor & Carter
                    And now the hearing
of this Cause is resumed and the States
Attorney and the Prisoner as also his atty
being now in open Court Whereupon
the Jury who had been duly Sworn and em-
paneled in this Cause on yesterday Came
into open Court and announced that they
Had not agreed to a verdict, Whereupon
they retired to Consider of their verdict
and thereafter on the Same day returned
into open Court and announced to the
Court that they Could not agree as to a verdict
Whereupon a mistrial was declared herein
and the defendant was remanded to Jail
and his Bond fixed at Two hundred and
fifty Dollars -

Whereupon the Grand Jury Came into open
Court and rendered the following
Indictments of the State of Fla
