     Wednesday November 17th 1880

The State of Florida }
       vs.           } Larceny
Fortune Montgomery   } And now this Cause
coming on to be heard W.A. Hocker states attorny
prosecuting in the name and by the Authority
of the State of Florida and the prisoner
appearing in his own proper person as well
as by his attorneys Mess Sanchez & McCall
whereupon the prisoner was arraigned and upon
his arraignment saith he is not guilty as
the Indictment alleges against him and
for good and evil he puts himself upon 
good and the County for trial whereupon
a Jury was called and there Came
S. Guthrie, George B. Evans, I.U. Malphurs,
Benj Haile, R.H. Hawkins, and J.K. Leary,
who were duly sworn and empanneled to well
and true try the issues joined and
thereafter after hearing the evidence the ar-
gument of Counsel and the charge of
the Court retired to consider of their
verdict under orders from the Court to
bring in a sealed verdit.

                      } McCall & Thrasher.
                      } And now this Cause coming
on to be heard W.A. Hocker states attorney pros-
ecuting in the name and by the Authoridy
of the State of Florida and the prisoner appear-
ing in his own proper person as well as by his 
attornies Messrs Thrasher & McCall and now the
prisoner being brought to the bar here under
the Custody of John W. Turner sheriff of Alachua
County to which sheriff he is also likewise com-
mitted and being forthwith demanded how
he would acquit himself of the charges against
him saith he is not guilty as the Indictment
alleges and for good and evil he puts
himself upon God and the County for Trial
whereupon a Jury was called and then
