                            And now this cause
     came on to be heard and the parties
     plaintiffs and Defendant being in open
     Court by their respective attorneys and the
     issues being joined a Jury was called and
     then came B.C. Johnson Wm Adams - C.J. Rivers
     Wm Bates W.A. Porter and C.E. Johnston who
     were duly sworn and empanelled to well and
     truly try the issues joined according to the
     evidence and thereafter after hearing the evidence
     the argument of counsel and the charge of the
     Court retired to consider of their verdict and
     thereafter on the same day returned into open
     Court and announced to the Court that they
     were unable to agree upon a verdict Whereupon
     a mistrial was declared
     Whereupon
         The Court adjourned until Monday
     Morng at Ten Oclock
