#2 Mack Thomas otherwise } night time with intent to commit a
called Madison Douglass } misdemeanor
} And now this Cause came
on to be heard William H. Wigg State attorney
prosecuting in the name and by the Authority
of the State of Florida and the prisoner ap-
pearing in open Court in his own proper
person was demanded how he would
acquit himself of the charge against him
saith that he is not guilty as the Indict-
ment alleges against him and for good and
evil he puts himself upon God and the County
for trial

And now this Cause came on
to be heard William H. Wigg State attorney
prosecuting in the name and by the authority
of the State of Florida and the prisoner ap-
pearing in open Court in his own proper person
as well as by Chas L. Fildes his atty and now
the prisoner being demanded how he would
acquit himself of the Charge against him
saith that he is not guilty as the Indictment
alleges against him and for good and evil
he puts himself upon God and the Country
for trial Whereupon a Jury was called and
there came, W.H. Harrison J.H. Avera Jr
D. Hicks, J.W. Carter W.N. Gillett W.D. Bailey
who were duly sworn and empanelled to well
and truly try the difference pending according
to the evidence and thereafter after hearing the
evidence the argument of Counsel or the Charge
of the Court retired to consider of their verdict
and thereafter on the same day returned into
