their verdict and hereafter on the same day returned
into open Court and rendered the following verdict
to wit: - We the Juror find the defendant Guilty
and ask for Mercy of the Court so say we all

to be heard and argument being had thereon
and now the Court being advised of His opinion
doth decide that said motion for a new trial
shall be overuled and said motion denied
to which decision and opinion of the Court then and
there in open Court the Defendant by his Counsel

And now the prisoner being in
open Court for sentence was demanded if he
had anything to say why sentence should not be
passed upon him saith nothing, Whereupon the
Court sentenced the prisoner to pay a fine of
Twenty five dollars together with the Costs of
this prosecution -

And now this Cause came on to
be heard William H. Wigg State attorney prosecuting
in the name and by the authority of the State of
Florida and the prisoner appearing in open
Court in his own proper person as well as by his
attys Mess Lewey & Carter the prisoner was arraigned
and upon his arraignment saith that he is not
guilty as the Indictment alleges against him
and for good and evil he puts himself upon
God and the Country for trial whereupon a Jury
was called and there came E.T. Finkley
