on to be heard on a motion for a new trial
and argument having been had therein and in
the Court being advised of his opinion doth
decide that said motion shall be denied

by his attorney and in open Court applies for
and enters his appeal from the Judgment herein
to rendered to the Supreme Court of the State
of Florida to be held at the City of Tallahassee
on the 2nd Tuesday in January A.D. 1890

an appeal had been entered in the above
cause to the Supreme Court of the State of
Florida to be held at Tallahassee and ap-
plication having been made to the Court in
open Court for an extension of time beyond
the present term in which to prepare and present
the bill of exceptions herein, Thereupon it is hereby
ordered that the defendant have until the first
day of October 1889 to prepare and present
their bill of Exceptions in this case
