him saith that he is not guilty as the Indict-
ment alleges against him and for good and
evil he puts himself upon God and the
Country for trial

And now on this day
this cause came on to be heard
William H. Wigg State attorney prosecuting
in the name and by the authority of the
State of Florida and the prisoner appearing
in open Court in his own proper person as
well as by G.J. Arnow his attorney was
forthwith demanded how he would
acquit himself of the Charge against
him saith that he is not guilty as the
Indictment alleges against him and
for good and evil he puts himself upon
God and the Country for trial Whereupon a
Jury was called and there Came
J.G. Rawls - D.H. Merchant, A.J. Palmer
J.M. Miller Jr E.K. Roberts T.E. Jones
who were duly Sworn and empanelled to well and
truly try the Difference pending according to the
evidence the argument of Counsel and
the Charge of the Court retired to Consider
of their verdict and thereafter on the
Same day returned into open Court and
rendered the following verdict to wit: -
13 of January 1890 We the Jurors find
the prisoner guilty but ask the Court
to be merciful as the Case will admit
so say we all D.H. Merchant
