Whereupon the Defendants in open Court filed their
notice of appeal from the Judgment and finding
of the Court in the words and figures following to wit:

vs } In Alachua Circuit Court, motion to set
Philip W. Cato} aside the Judgment in said suit
} And now comes the plaintiff to said suit
by Thos F. King his attorney in open Court and applies
for & enters his appeal from the order of the Court sus-
taining the said motion & setting aside said Judgment

heard W.A. Hocker State attorney prosecuting in the
name and by the authority of the State of Florida
and the prisoner appearing in his own proper person
as well as by his attorneys Thrasher & McCall, And the
Court having ordered a Severance in the Indictment
as to Daniel Lee, Jim Foster, Joe Wilds and Sam
