And now the prisoner being
in open Court for sentence and being demanded
if he had any thing to say why sentence should
not be passed upon him saith nothing
Whereupon the Court sentenced the prisoner
to confinement in the States prison at hard
labor for the term of Five (5) years -

And now this Cause
Came on to be heard on a motion for
a change of Venue, and after argument
had thereon both for the Defendant and
the State as also the affidavit of the
defendant and of his Counsel C.L. Fildes
as also the testimony of Samuel H. Wienges
Sheriff and of J.A. Carlisle Clerk of this
Court and now the Court being advised of
His opinion doth decide and order that
said motion for a change of Venue shall
not be granted - to which said order and
ruling of the Court the defendant by his
Attorney then and there excepted -
Whereupon the Court adjourned until tomorrow
morning at Ten Oclock

adjournment of yesterday His Honor J.J. Finley
Judge presiding
Whereupon comes Samuel H. Wienges Sheriff of
Alachua County and returns the special
Venire for Twenty Five as having been executed
by summoning Henry Townsend J.J. Dinkins, C.E. Haile Jr.
J.J. Jones E.C. Bailey, W.P. Barr W.W. Townsend
Wm L. Parker, R.T. Thomas C.H. Chrisman, J. Katz
