And now on this day this
cause came on to be further heard and William
H. Wigg State Attorney prosecuting in the name
and by the authority of the State of Florida and
the prisoner appearing in open Court in his
proper person as well as by his attorneys Messrs
C.L. Fildes, S.Y. Finley & Taylor & Carter as also like
wise the Jurors who had been selected herein
on the 31st day of January A.D. 1890 to wit =
F.D. Peterson, J.M. Love W.H. Holbrook, M.I. Jones
J.M. Everet, Burrel Wiggins, Wm Mills, D.G. Harvard
J.A. Barry - being in open Court the hearing of
this cause was resumed Whereupon there came
as Jurors in this Cause 1- F.D. Peterson 2 J.M.
Love 3 W.H. Holbrook 4 M.I. Jones 5 J.M. Everett
6 Burrel Wiggins 7. Wm Mills 8 D.G. Harvard 9. J.A. Barry
10 J.J. Dinkins 11 W.P. Barr 12 R.T. Thomas who
were duly sworn and empanelled to well and
truly try and true deliverance make between the State
of Florida and the Prisoner at the Bar according
to the evidence and thereafter after hearing a part
of the evidence -
Whereupon the Court issued the following order
to wit
In Circuit Court in and for Alachua
County Fall Term 1889
The list of 300 from whom the regular Venires are
to be drawn having been declared void and there
being no Petit Jury drawn and Summoned in the
manner required by law it is ordered that the Clerk
do issue a special venire for 18 persons duly
qualified to Serve as Petit Jurors said Venire to be
directed to the Sheriff Commanding him to Summon
from the body of the County at Large Eighteen
persons duly qualified to Serve as Jurors for the
Seventh Week of the present term and that
said Venire be returnable on Monday 3rd Feb
