       Fall Term A.D. 1889
       Wednesday February 12th 1890
       The Court met this day His Honor J.J. Finley
       Judge presiding -

       Whereupon Comes Samuel H. Wienges Sheriff of
       Alachua County and returns the Venire Facias
       for the Petit Jury for this the 8th Week of this
       term as having been duly executed by
       Summoning J.B. Butts, N.J. Barry Jr. Reuben May
       S.W. Lambert Daniel Mott Charney Thomas
       T.J. Montgomery Jr. John Roberts Frank Starke
       S.L. Hawthorn W.C Dampier T.R. Picket Oscar
       Thigpen Henry Willis, Jasper N. Wilson and
       that John Sweat Wm Thomas and Wm B. Lewis
       are not to be found in the County -

       Whereupon the Court for good Cause shown
       excused S.L. Hawthorn and John Roberts
       from further attendance on the Court

       State of Florida }
# 4            vs       }  assault with intent to Rape
       Joe Smith        }
                          And now on motion of the
       State this cause is nol prosed -

       State of Florida }  Wigg S.Y. Finley & Taylor & Carter
# 49          vs        }             Murder
       Dave Lewis       }  C.L. Fildes
                         And now on this day this
       Cause came on to be further heard and
       William H. Wigg State attorney prosecuting in
       the name and by the authority of the State of
       Florida and the prisoner Dave Lewis being in
       open Court in his proper person as well as by
       his attorney C.L. Fildes Esqr and also likewise
       the Jury who had been duly Sworn and 
       empanelled herein and who had heard a part
       of the evidence herein to wit:- T.E. Horn, H.L.
       Hilliard S.J. Collins, Henry Thomas John
       Edwards John Simmons Charney Thomas
       Daniel Mott James Slater Daniel Chesser
       F.W. Caroway W.S. Jackson being also in open
       Court the hearing of this Cause was resumed
       and the Jury aforesaid after hearing the
       balance of the evidence -
