Whereupon the Court sentenced the prisoner to con-
finement in the States Prison at hard labor
for the term of Four (4) years -

And now this cause came on
to be heard on a Plea in abatement and after
argument had therein and the presentation of an
agreed state of facts to the Court in writing and
now the Court being advised of His opinion doth
decide and order that the plea in abatement
is well taken and is sufficient and that the
Same is hereby sustained
And now comes the State attorney and by
leave of the Court files an Information of
The State of Florida }
vs } Carrying on business as
Joseph Simonson } a dealer in Spirituous wines
and malt liquors without license

adjudged by the Court that all Causes and
