And now this Cause came on
to be heard and after argument had therein and the
assignment of errors herein, the Court doth decide
and order that the Judgment of the Court below
Shall be reversed and set aside and that the
appellee do pay the Costs of this appeal -

and now this Cause is
dismissed for the Want of prosecution
Whereupon the Court issued the following order
to wit:-
It appearing to the Court that there is a
necessity for a Petit Jury for the Second week of
this the Spring Term A.D. 1890 It is ordered that the
County Judge or in his absence a Justice of the
Peace The Sheriff^ or in his absence a Sworn deputy^
and the Clerk of the Circuit Court of Alachua County
do in open Court draw from the Box Containing the
the list of Three hundred selected Jurors the
names of Eighteen (18) persons to Serve as Petit Jurors
for the 2nd Week of this Term and also that the
Clerk of this Court do issue a Venire Facias
directed to the Sheriff of the County Commanding
him to Summon said Eighteen (18) persons so drawn
Said Venire to be returnable at ten oclock A.M.
on Tuesday the 13th day of May A.D. 1890
