in this Cause is quashed
on motion of Defendants attorney and the
prisoner ordered to be discharged -

And now on this day this
cause came on to be heard on a motion to
withdraw the plea in bar or for leave to file a plea
in abatement which motion is ordered to be granted
and this cause is continued by consent -
Whereupon it is ordered that all causes pending
on the Criminal Docket shall be continued until
the next regular term of this Court

argument had thereon it is ordered by the

new trial herein and after argument had
thereon the Court being now advised of His
opinion doth decide and order that said
motion for a new trial herein shall be
denied to which ruling the Defendant
by his atty then and there excepted
It is also ordered that the Defendant
be allowed thirty days in which to file its
Bill of Exceptions herein and in which to
perfects its appeal
