     Whereupon Comes J.A. Carlisle the Clerk of this
     Court and in open Court issued a Venire for
     the one hundred names drawn by the order of 
     this Court.

     filed their plea in abatement, and the Court now
     being advised of His opinion doth decide that said
     Plea shall be sustained and also that the indict-

     be nol prossed.  Whereupon both the Defendants
     and all the witnesses in said Cause were dis-
     charged without day
