vs } Breaking and entering a building
John Doe } in the day time with intent to
} Commit a Felony - Ashley & Finley
And now on this day this
Cause came on to be heard William H. Wigg State
attorney prosecuting in the name and by the
authority of the State of Florida and the prisoner
appearing in open Court was demanded how he would
acquit himself of the charges against him is mute and
refused to plead. Whereupon the Court ordered that a plea
of not guilty be entered for the prisoner and therefore
the Court appointed J.W. Ashley & S.G. Finley Esqr to defend the
prisoner in the cause Whereupon a Jury was called and
then came C.C. Martin James W. Exley, W.H. Hinson
Joe DeSha B.F. Hampton Tobias Brown who being
duly Sworn and empanelled to well and truly try the
Difference pending according to the evidence and
the Jury aforesaid after hearing the evidence the
argument of Counsel and the Charge of the Court
retired to consider of their verdict and thereafter
on the same day returned into open Court and
rendered the following verdict to wit: We the Jury
find the prisoner Guilty B.F. Hampton

And now on this day the prisoner
John Doe being in open Court for sentence was
demanded if he had any thing to say why sentence
should not be passed upon him saith nothing
Whereupon the Court sentenced the prisoner John
Doe to Confinement in the State Prison at hard
labor for the term of Five (5) years -
