Thursday February 5th 1891
Court to allow the Prisoner to withdraw his plea
of not guilty heretofore made and that he might
be allowed to interpose a Plea in Abatement to
the Grand Jury which found the Indictment in
this Cause and now after argument had on
said motion the Court doth decide that said
motion shall be overruled and that the same shall
not be granted to which ruling and decision
of the Court the Defendant there and then
excepted -- Whereupon the trial of this Cause
was proceeded with and the Jury aforesaid
after hearing the evidence the argument of
counsel -- and the Charge of the Court retired
to Consider of their Verdict and thereafter on the
same day returned into open Court and rendered
the following verdict to wit: We the Jury
find
the Defendant not guilty. B.F. Hampton

Whereupon the Court adjourned until tomorrow
morning at nine oclock
