And now this Cause came on
to be heard William H. Wigg State attorney of the Fifth
Judicial Circuit prosecuting in the name and by
the authority of the State of Florida and the prisoner
appearing in open Court in his proper person as well
as by his attorneys S.L. Carter, R.W. Davis, J.N. Leggitt, Hugh
Miller and Ashby & Davis, and now the prisoner Barton
Albert Thrasher being brought to the Bar here under the
Custody of L.W. Fennell the Sheriff of Alachua County
to which Sheriff he is also likewise committed was demanded
how he would acquit himself of the charge against him
Whereupon comes the Prisoner by his attorneys Sought to
interpose a Demur to the Indictment To which inter-
posing of said demur being filed the State by Honr William
H. Wigg States attorney objected on the ground that said
demur was not certified to by Defendants Counsel as
required by the rules of this Court and now before the
Court had ruled upon the motion and before
plea had been made to the Indictment this Cause
is Nol Prosed by the State.

Gaines being called failed to answer
whereupon his Sureties Henry Gaines, H.C. Denton and J.Z.
Feltner were thence called and commanded to bring the body
of Frank Gaines into Court as they had obligated to do
and in default thereof that their bond would be forfeited
And now the securities having failed to produce the body of
Frank Gaines the Bond was ordered to be estreated and
that a Scire Facias against the Defendant and his
Sureties be issued returnable to the next term of this Court
and alias Capias ordered for Frank Gaines |
