And now comes the prisoner
by his attorneys sought to interpose a Demurrer to the
Indictment To the filing of said Demur now
comes William H. Wigg States Attorney and objects
to the filing thereof on the ground that said Demur is
not accompanied with the Certificate of Counsel
as required by Rule 26 of the Rules of Court - and
now the Court doth decide as follows to wit: -
It is ordered that the above and foregoing objection
be and the same is hereby sustained and that the
said demur be not allowed to go upon the files
in this case to this ruling of the Court the accused
by his Counsel Excepts J.J. Finley
