its value of the said boxes ordered that complainant and defendants do file
affidavits as to the value of said boxes and they be allowed until Saturday
February 11th AD 1899 at 3 O'clock PM for that purpose.
Now this cause coming on further at that time to be heard such affidavits having
considered the same, It is hereby ordered that said motion be and the same is
hereby granted and that the defendant Solomon Simon is hereby allowed to resume
possession of the refrigerators which were by order of this Court dated June 10th 1898
ordered to be placed in the hands of John F. Bartleson as Receiver herein upon the
said Solomon Simon or some one on his behalf Entering into a bond in the
sum of One thousand Dollars payable to the complainant G.F. Sickles
condition to pay him whatever sum may be found due him upon a
final decree in said cause said bond to be executed by two good and
sufficient sureties or by a Guarantee Company doing business in this
State and to be approved by the Clerk of the Circuit Court of Alachua
County Florida, and it is further ordered that upon notice to him by
the said defendant or his solicitor or agent of the making and
approval of said bond the said John F. Bartleson Receiver herein
is ordered to deliver to the said Solomon Simon or his agent Joseph J.
Tinsley all the boxes or refrigerators which were delivered by the said
Tinsley to the said Receiver, or any other Boxes or refrigerators which
may have come in his possession as such Receiver since the date of the
order appointing him receiver in this cause

Turner & Butler }
             This cause is before me on motion of defendants to dissolve
the Injunction granted by the Court Commission. It appears
from the Bill as amended the debt in the execution injoined
was incurred prior to the issuing of the Patent from the Government of the
US to the land levied upon & a sale of which is injoined and that
said land was acquired under the United States Homestead law =
under that law the debt could not be made out of the land levied on
& advertised. While the order of the Court commissioner does not show
the absence of the Judge from the County when he made the order -
as a matter of fact the Judge was absent and it is that fact which
gave him Jurisdiction. I overrule the motion to dissolve the Injunction
