equities of the cause are with defendant C.W. White and it is
therefore ordered adjudged and decreed that the Bill with its amend
ments as to the defendant C.W. White be and the same is hereby dismiss
ed and that he recover his costs in this behalf expended to be taxed

           This cause coming on to be heard B.A. Thrash
er Solicitor appearing for the complainant no one appearing
for the defendant, and it appearing to the court from the
Bill of Complaint the decree pro confesso, and the testimony
taken before the Master that the allegations of the Complainant
are sustained and proven, and that the defendant has wilfully
and obstinately deserted the complainant his wife for a term
more than one year before the filing of the bill in this cause
and it further appearing to the Court from the Bill and testi
mony that said defendant by reason of his desertion and fail
ure to support of their minor child, It is therefore ordered
considered adjudged and decreed by the Court that the prayer of
the complainant be granted, and that the bonds of matrimony
heretofore existing between the said Emma A. Fay and T. Halland
Fay, be and the same is hereby dissolved and that the said
parties and each of them are and is freed and discharged from
the obligations thereof and that the complainant Emma A.
Fay do have the care custody control management and
direction of the minor child T. Halland Fay during his mi
nority without any interferance from the defendant herein
