                      This cause coming on to be heard on
final hearing on appeal and being argued and the Court having
heard and considered the same and being advised in the premises
it is ordered that the same be affirmed and that the said cause
be remanded for further proceedings in conformity with the
decision of the Court belong. And that the Costs of this appeal to be collected by the Court below****
   be taxed against the appellants

         Now comes the plaintiff in the above styled cause
by his attorneys W.H. Palmer and Robert E. Davis and moves the
Court to overrule the motion of the defendants filed in the
above styled cause on the 9th day of May 1899 and to enter
default judgment against the defendants therein for failure
to plead to the declaration of the plaintiff on or before the
9th day of May AD 1899 as required by order of said court
dated April 28, 1899.

          And now said motion being presented to the Court
and argued by counsel for the respective parties and the
Court being advised in the premises made the following
order
      It appearing to the Court that the plaintiff has
amended the declaration as required by the order of the
Court, the motion of the defendant to dismiss the cause
is denied. It is further ordered that the motion for a
default for failure to plead is denied. It is further ordered
that the defendants plead to the declaration on or before
the rule day in June AD 1899. To which ruling and order
of the Court the defendants by their attorneys there and then
excepted.
